Terms of Service

1. Acceptance of Terms

By accessing or using the Cipher platform ("Service") operated by Cipher Security, Inc. ("Cipher," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Cipher is an AI-native application security platform that scans source code repositories for vulnerabilities, verifies findings through automated exploit generation, and delivers actionable security reports. The Service includes web-based dashboards, API access, CI/CD integrations, and related tools.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate, complete information and promptly update it if it changes. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

• —Use the Service to scan repositories you do not have authorization to test
• —Attempt to circumvent rate limits, access controls, or security measures
• —Use exploit verification outputs to attack systems you do not own or have permission to test
• —Reverse engineer, decompile, or disassemble any part of the Service
• —Use the Service for any illegal purpose or in violation of applicable laws

5. Intellectual Property

The Service, including its software, design, documentation, and branding, is owned by Cipher Security, Inc. and protected by intellectual property laws. You retain all rights to your source code and data. We claim no ownership over code you submit for scanning.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Source code submitted for scanning is processed in ephemeral environments and is not persisted after analysis completes. Scan results are stored in your account and may be deleted at any time.

7. Subscription and Payment

Certain features require a paid subscription. Fees are billed in advance on a monthly or annual basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CIPHER DOES NOT WARRANT THAT THE SERVICE WILL DETECT ALL VULNERABILITIES OR THAT SCAN RESULTS WILL BE ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CIPHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Cipher, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
